By accessing and using Surround Think's services, including the Think Board of Advisors, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Description of Service

Surround Think provides AI-powered advisory services, including:

• Think Board of Advisors: Create custom AI personas for strategic guidance
• Train: High-stakes conversation training (Development Dojo)
• Know: Conversation synthesis and analysis (Synthesis Engine)
• Go: Travel planning and coordination

3. User Accounts

3.1 Account Creation

You must create an account via OAuth (Google, Apple, etc.) to access Think Board. You are responsible for maintaining the security of your account credentials.

3.2 Account Eligibility

You must be at least 16 years old to use our services. By creating an account, you represent that you meet this age requirement.

3.3 Account Termination

You may delete your account at any time through the Dashboard. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to use our services to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Distribute malware, spam, or malicious content
• Attempt to gain unauthorized access to our systems
• Use the service for illegal activities or fraud
• Create personas that promote hate speech, violence, or illegal activities

5. Intellectual Property

5.1 Our Content

All content, features, and functionality of Surround Think (including but not limited to text, graphics, logos, and software) are owned by us and protected by copyright, trademark, and other intellectual property laws.

5.2 Your Content

You retain ownership of personas, conversations, and other content you create ("User Content"). By using our services, you grant us a license to store, process, and display your User Content solely to provide our services.

5.3 AI-Generated Content

Content generated by AI (including persona responses and avatars) is provided "as is" without warranties. You are responsible for reviewing and using AI-generated content appropriately.

6. Third-Party Services

Our services integrate with third-party providers (Google Gemini AI, OAuth providers, etc.). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service availability or performance.

7. API Usage and Costs

Think Board requires you to provide your own Google Gemini API key. You are responsible for:

• Obtaining and maintaining a valid API key
• All costs associated with API usage
• Complying with Google's API terms of service
• Managing your API quotas and rate limits

8. Disclaimers and Limitations

8.1 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or technical issues.

8.2 AI Limitations

AI-generated advice and content may contain errors, biases, or inaccuracies. Think Board is a tool for exploration and should not replace professional advice from qualified experts.

8.3 No Warranties

Services are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Surround Think shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

10. Indemnification

You agree to indemnify and hold harmless Surround Think from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

11. Data Export and Portability

You may export your data at any time through the Dashboard's "Download My Data" feature. Exported data is provided in JSON format for portability.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes via email or through a prominent notice on our website. Your continued use after changes constitutes acceptance of the updated terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
